• Operate within a 150 air-mile radius of their normal work
reporting location
• Return to the same reporting location at the end of the
workday Cell phone usage
• Complete their work within a maximum duty period
allowed by FMCSA regulations
• Maintain accurate time records through the employer

Drivers who qualify for the short-haul exemption are not required to maintain traditional Records of Duty Status (RODS) and typically do not need to use ELDs. This exemption is commonly used by:

• Local delivery fleets
• Construction companies
• Utility service providers
• Municipal fleets

If a driver exceeds short-haul limits, motor carriers may need to equip an ELD system in order to avoid potential violations from enforcement personnel.

Commercial motor vehicles with engines manufactured before the year 2000 are exempt from ELD compliance.
This exemption exists because many older vehicles lack the electronic engine control modules (ECMs) that modern ELDs rely on to automatically capture vehicle data.

Even though an ELD is not required, many carriers still choose to use fleet tracking and compliance tools to simplify recordkeeping and improve operational visibility.

The adverse driving conditions exemption allows drivers to extend their maximum driving time when unexpected weather or traffic conditions make it impossible to complete a trip safely within normal Hours of Service limits.
Examples include:

• Sudden snowstorms
• Flooding
• Unplanned road closures
• Major traffic accidents causing delays

Under this exemption, drivers may extend their driving window by up to 2 additional hours. However, the conditions must have been unforeseen when the trip began. Routine traffic congestion or weather that was reasonably predictable does not qualify.
Also note that the exemption extends driving time but does not eliminate the requirement to take required breaks or maintain accurate Records of Duty Status. Not following FMCSA regulations could lead to violations that may affect your CSA scores.

The agricultural exemption applies to drivers transporting agricultural commodities, livestock, feed, fertilizer, and certain farm-related products during planting and harvesting seasons.
Drivers operating under this exemption may be exempt from Hours of Service regulations while traveling within a 150 air-mile radius of the source of the agricultural commodity.
Common examples include:

• Grain haulers
• Livestock transporters
• Produce carrierscarriers
• Fertilizer and seed delivery vehicles

Once a driver travels beyond the 150 air-mile radius, normal Hours of Service requirements begin to apply.
Because agricultural seasons vary by state, motor carriers should verify the applicable planting and harvesting periods for the states in which they operate.
